Supreme Court Bans Construction Near Jojari River to Curb Pollution
Why is this news?
The Supreme Court has imposed an interim ban on all construction and development activities within 100 metres of the edge of the Jojari River in Rajasthan because of serious ecological degradation and pollution of the river system.
The Court has also prohibited industries or activities capable of causing pollution, contamination or other damage to the river ecosystem within 500 metres on either side of the existing flood line. Where the flood line has not yet been identified, the 500-metre restriction applies from the river’s present flow path.

The difficult question is:
What happens when a person is captured by another individual’s smart glasses without actively providing their data?
The wearer may have purchased the device and agreed to its terms.
But the bystander may never have interacted with the company or given consent.
This makes wearable AI particularly challenging for privacy regulation.
Recent analysis has pointed out that existing legal frameworks often address harms after misuse occurs, rather than providing a comprehensive regulatory framework specifically designed for AI-powered wearable devices.
Privacy vs Public Space
Another important legal and ethical question is:
“Do people have less privacy in public places?”
Being in a public place does not necessarily mean that every form of surveillance or data processing becomes acceptable.
There is a difference between:
Seeing someone in public
and
Systematically recording, identifying, storing and analysing information about that person.
AI makes the second possibility much more powerful.
This creates the need to rethink the traditional concept of reasonable expectation of privacy as technology becomes increasingly pervasive.
Major Privacy Concerns
- Non-consensual recording
People can potentially be photographed or recorded without their knowledge.
- Facial recognition
AI could identify individuals captured by the camera.
- Biometric data
Faces, voices and other biological characteristics can constitute sensitive information depending on the legal framework and context.
- Data storage
Questions arise regarding:
- Where is the data stored?
- For how long?
- Who can access it?
- Can it be transferred?
- Secondary use
Data collected for one purpose could potentially be used for another purpose.
- Profiling
AI could analyse people’s:
- identity
- behaviour
- preferences
- movements
- surroundings.
- Surveillance
Widespread use could gradually normalise continuous surveillance in public spaces.
Privacy and Women’s Safety
Smart glasses also raise gender and safety concerns.
Discreet recording can facilitate:
- harassment
- stalking
- voyeurism
- non-consensual sharing of videos
- online abuse.
Recent reporting in India has highlighted concerns about women and other individuals being recorded without consent through wearable AI devices.
Therefore, the issue is not only about data protection but also about human dignity, safety and gender justice.
Existing Laws May Address the Harm — But Not the Technology
This is an important distinction.
Suppose someone uses smart glasses to record another person and then uses the footage for harassment.
Existing criminal and cyber laws may potentially apply to the harmful conduct.
But the broader question remains:
Should the technology itself have specific safeguards governing when and how recording can occur?
This is the regulatory gap highlighted by the smart-glasses debate.
Global Regulatory Response
Different jurisdictions are beginning to consider specific restrictions.
For example, some U.S. jurisdictions have considered requirements relating to:
- recording indicators,
- biometric data,
- consent,
- restrictions in sensitive locations.
New York has also restricted the use of smart glasses in courts, while proposals elsewhere have focused on visible indicators showing when recording is taking place.
This demonstrates a broader global trend:
Technology is advancing faster than traditional privacy regulation.
India’s Regulatory Challenge
India needs to balance:
Innovation
AI + Wearables + Start-ups + Digital economy
with
Individual rights
Privacy + Consent + Dignity + Security
The objective should not necessarily be to ban smart glasses.
Instead, India needs risk-based regulation.
Way Forward
- Privacy-by-design
Manufacturers should build privacy protections into the device from the beginning.
- Strong recording indicators
A clear and difficult-to-disable indicator should show when recording is occurring.
- Consent mechanisms
Rules should distinguish between:
- recording the wearer,
- recording bystanders,
- recording in private spaces,
- recording in sensitive locations.
- Sensitive-location restrictions
Use could be restricted or prohibited in places such as:
- courts
- hospitals
- examination centres
- secure government facilities
- certain educational institutions.
- Data minimisation
Collect only the data that is necessary for the stated purpose.
- Limited retention
Data should not be retained indefinitely.
- Strong accountability
Manufacturers and data-processing entities should have clear responsibilities.
- Public awareness
People should understand the privacy implications of emerging wearable technologies.
